How to Register Trademark in Dubai

Trademark registration in UAE is quite safe and secure as UAE has been a member of Paris Convention for the Protection of Industrial Property since 1996. UAE government is also keen to follow the International Classification of Good and Services for the Purpose of the Registration of Marks under the Nice Agreement, 10th Edition.

The process for trademark registration in Dubai is as follows:

  1. An application for initial search must be submitted to the Trademarks Registration Office. Initial investigation will be conducted who will examine the application and check if trademark was registered before or not.
  2. If trademark has not been registered before, an application with all required documents including the image of the targeted Trademarks will be filed, and the fees must be paid.
  3. Once approved and accepted by the Registrar, the trademark will get published in two local newspapers and the Trademark Journal. . The Trademark Office will receive the paper cuttings of the notices published in newspapers and the Trademark Journal.
  4. If there is any opposition to the registration of Trademark, it will have to file a notice against the published trademark within the 30 days from the date the trademark was published.
  5. The Registrar will make a decision regarding the opposition’s objection to the registration of trademark. Registrar’s decision can be appealed to the Committee and the Committee’s decision can be challenged in the court of law.
  6. If there is no credible opposition to the registration of trademark, then the trademark is registered and the certificate is issued.

Filling Requirements

 

  1. Twenty prints of the trademark. (Size: 6 cm x 6 cm)
  2. A notarized and legally attested Power of Attorney submitted to the UAE Consulate. Late submission of POA can be made as late as within the 60 days from the filing date.
  3. Copy of the applicant Certificate of Incorporation (for corporate applicants only).
  4. Copy of the applicant passport.
  5. A copy of certified home/foreign application registration, in case priority is claimed.
  6. Certificates of Trademark registration if registered in any other countries.
  7. Legal translation for the wording which might be included in your trademark. We will need translation from your language of origin to English. The translation from English to Arabic will be handled by our team at KWSME as we also provide legal translation services.

Renewal of Trademark

A registered trademark has a valid life of 10 years in the UAE and the registration can be renewed for the same period.

A renewal application can be submitted and applicable fees paid just before the trademark’s expiry is approaching near. Late submission of application for renewal of trademark can also be filed with a fine within 3 months of grace period allowed after the expiry. Once the renewal application is approved, the trademark is again published in at least two local newspapers and the Trademark Journal and the same process mentioned above repeats.
